PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE ENROLLING IN ANY VALLEY TROUBADOURS PROGRAM OR USING THIS WEBSITE. BY SUBMITTING AN ENROLLMENT FORM, MAKING A PAYMENT, OR OTHERWISE ACCESSING OUR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS.

 

1.  Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Enrollee," "Parent," "Guardian," or "you") and Valley Troubadours, LLC ("Valley Troubadours," "we," "our," or "us"), a Wisconsin limited liability company, and, where applicable, its affiliated nonprofit organization Troubadours Music Boosters, Inc. ("Boosters"). These Terms govern your enrollment in and use of Valley Troubadours music education programs and services (collectively, the "Services") and your access to and use of www.valleytroubadours.com (the "Site").

 

If you are enrolling a minor student, you represent and warrant that you are the parent or legal guardian of that student and have full authority to enter into these Terms on the student's behalf. References to 'you' include both the enrolling parent or guardian and the enrolled student.

 

We reserve the right to modify these Terms at any time. Changes are effective upon posting to the Site. Your continued enrollment or use of the Services following any modification constitutes your acceptance of the revised Terms.

2.  Program Description

Valley Troubadours, LLC offers private and group music instruction, ensemble programs, band, choir, and related music education activities for students of all ages in the greater [Wisconsin] area. Programs may include but are not limited to:

  • Private instrument lessons;

  • Group classes and ensemble instruction;

  • Band and choir programs;

  • Recitals and performances;

  • Seasonal and specialty programs; and

  • Such other programs as Valley Troubadours may offer from time to time.

 

Program offerings, scheduling, tuition rates, and availability are subject to change at any time at Valley Troubadours' sole discretion. Valley Troubadours reserves the right to modify, suspend, or discontinue any program or class at any time with reasonable notice to enrolled families.

3.  Enrollment and Registration

​

3.1  Enrollment Process

Enrollment is completed through the Enrollsy online enrollment platform accessible via the Site. Enrollment is subject to availability and the satisfaction of any applicable prerequisites, age requirements, or other eligibility criteria established by Valley Troubadours. Valley Troubadours reserves the right to accept or decline any enrollment application at its sole discretion.

 

3.2  Registration Fee

A non-refundable registration fee may be assessed at the time of enrollment. The registration fee amount will be disclosed prior to completion of enrollment. Payment of the registration fee is required to secure a student's enrollment in a program.

 

3.3  Program Forms

Prior to or upon enrollment, we may ask you to complete additional program-specific forms, including instrument preference surveys, pre-registration questionnaires, emergency contact forms, and health or accessibility disclosures. Submission of required forms is a condition of participation.

 

3.4  Age Requirements and Eligibility

Certain programs have minimum or maximum age requirements. Valley Troubadours may, at its discretion, grant exceptions to age-based requirements. Registration in age-restricted classes is subject to override by Valley Troubadours staff.

 

3.5  Waitlists

If a program is at capacity, you may be placed on a waitlist. Waitlist positions are time-stamped in the order received. Valley Troubadours may move waitlisted students into programs as capacity permits, at Valley Troubadours' sole discretion. Being placed on a waitlist does not guarantee enrollment.

 

3.6  Scholarship and Financial Assistance

Valley Troubadours may, from time to time, offer scholarships or financial assistance programs. Availability, eligibility requirements, and award amounts are determined solely by Valley Troubadours and are subject to change or discontinuation without notice.

4.  Tuition, Fees, and Payment

4.1  Tuition Rates

Tuition rates for each program are as published on the Site or in enrollment materials at the time of registration. Valley Troubadours reserves the right to adjust tuition rates at any time. Rate changes will apply to the next applicable billing period.

 

4.2  Family Account and Multi-Student Enrollment

Each enrolled family is assigned a single family account, which may include an unlimited number of students. Family discounts, multi-student pricing, or other promotional rates, if offered, will be described in enrollment materials and are subject to Valley Troubadours' then-current pricing policies.

 

4.3  Payment Processing

Payments are processed through Valley Troubadours' designated payment processor. By providing payment information, you authorize Valley Troubadours to charge your payment method for tuition, fees, and any other amounts due under these Terms. Payment information is handled and secured by our third-party payment processor; Valley Troubadours does not store full payment card numbers.

 

4.4  Charter School and Virtual School Funding

Valley Troubadours may accept tuition payments made through charter school, virtual school, or other school choice funding mechanisms ("Charter/Virtual Funding") where available and permitted. Families seeking to pay with Charter/Virtual Funding are responsible for initiating and completing the applicable funding request process. Valley Troubadours makes no representation regarding eligibility for any particular funding program and reserves the right to decline Charter/Virtual Funding at its discretion.

 

4.5  Late Payments

Tuition and fees are due on the dates specified in enrollment materials or invoices. Valley Troubadours reserves the right to assess late fees, suspend participation, or disenroll a student for non-payment. Valley Troubadours will use reasonable efforts to notify you before taking such action.

 

4.6  Refund Policy

Registration fees are non-refundable. Refunds of tuition paid, if any, are at Valley Troubadours' sole discretion. We do not guarantee refunds for absences, withdrawals, program cancellations due to weather or facility issues, or any other circumstance unless otherwise expressly stated in writing. If Valley Troubadours cancels a program prior to its start date through no fault of the enrollee, Valley Troubadours will use reasonable efforts to provide a make-up option or credit.

 

To request a refund or credit, contact customercare@belfryhall.com. All requests will be evaluated on a case-by-case basis.

5.  SMS Text Messaging Terms

Program Name: Valley Troubadours  |  SMS Service Operated by Valley Troubadours, LLC via Enrollsy / Twilio

 

5.1  Program Description

By providing your mobile telephone number and consenting to receive SMS messages from Valley Troubadours (including through the enrollment form opt-in), you agree to receive automated and non-automated text messages from Valley Troubadours. These messages are operational and transactional in nature and may include:

  • Class reminders, schedule changes, and cancellations;

  • Billing notifications and payment confirmations;

  • Enrollment availability and waitlist updates;

  • Program announcements, new program opportunities, recitals, and events; and

  • Other service-related communications.

 

Consent to receive SMS is a standard element of enrollment in Valley Troubadours programs. Because all SMS messages are operational in nature, opting out will affect your ability to receive time-sensitive service communications.

 

5.2  Message Frequency

Message frequency varies depending on your enrollment status and account activity. You may receive multiple messages per week during active enrollment periods.

 

5.3  Message and Data Rates

Message and data rates may apply. Contact your wireless carrier for details about your plan's messaging rates.

 

5.4  How to Opt Out and Get Help

To stop receiving messages: Reply STOP to any text message at any time.

For help or information: Reply HELP to any message or email customercare@belfryhall.com.

 

After texting STOP, you will receive a single confirmation message. You will then no longer receive SMS messages from Valley Troubadours unless you re-enroll in the program.

 

5.5  No Carrier Liability

Carriers are not liable for delayed or undelivered messages.

 

5.6  Privacy of SMS Data

Mobile phone numbers and SMS opt-in consent data will not be sold, shared, or transferred to any third party or affiliate for marketing or promotional purposes. For full details, see our Privacy Policy at www.valleytroubadours.com.

6.  Conduct, Attendance, and Participation

​

6.1  Code of Conduct

All students, parents, guardians, and visitors are expected to treat Valley Troubadours staff, instructors, and fellow students with respect. Valley Troubadours reserves the right, in its sole discretion, to disenroll any student or remove any individual from a program or the premises for conduct that is disruptive, disrespectful, threatening, or otherwise inconsistent with a positive learning environment.

 

6.2  Attendance

Regular attendance is important to student progress. We request that families provide advance notice of planned absences when possible. Valley Troubadours does not guarantee make-up lessons for absences, though make-up options may be available at instructor discretion.

 

6.3  Late Arrivals and Early Departures

Valley Troubadours is not responsible for supervising students outside of scheduled class times. Please ensure students are picked up promptly following their scheduled class or program.

 

6.4  Photography and Recording

Valley Troubadours and its staff may photograph or record students during programs, rehearsals, recitals, and other activities for educational, promotional, and internal purposes. By enrolling, you grant Valley Troubadours a non-exclusive, royalty-free license to use photographs, videos, and recordings of your student (without identifying personal information) for Valley Troubadours' marketing, promotional, and program materials. If you do not consent to this use, please notify us in writing at customercare@belfryhall.com at the time of enrollment.

7.  Health, Safety, and Emergency Information

You agree to provide accurate and complete emergency contact and, if relevant, medical information for enrolled students. Valley Troubadours will use this information solely for student safety and emergency purposes. You represent that you have authority to consent to reasonable emergency medical care on behalf of the enrolled student in the event that a parent or guardian cannot be reached.

 

Students with special needs, disabilities, or medical conditions requiring accommodation should disclose relevant information at the time of enrollment so that Valley Troubadours may make reasonable efforts to accommodate the student's participation.

8.  Limitation of Liability; Disclaimer of Warranties

IMPORTANT — PLEASE READ THIS SECTION CAREFULLY. IT LIMITS VALLEY TROUBADOURS' LIABILITY TO YOU.

 

8.1  Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. VALLEY TROUBADOURS DOES NOT WARRANT THAT THE SITE OR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

 

8.2  Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VALLEY TROUBADOURS, LLC, TROUBADOURS MUSIC BOOSTERS, INC., OR THEIR RESPECTIVE MEMBERS, MANAGERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR ENROLLMENT, PARTICIPATION IN ANY PROGRAM, OR USE OF THE SITE OR SERVICES, EVEN IF VALLEY TROUBADOURS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

 

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VALLEY TROUBADOURS' TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT OF TUITION PAID BY YOU TO VALLEY TROUBADOURS IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

 

SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

 

8.3  Assumption of Risk

Participation in music programs involves physical activity. You acknowledge and accept any inherent risks associated with your student's participation in Valley Troubadours programs, including risks associated with participation in performances and recitals.

 

8.4  Indemnification

You agree to indemnify, defend, and hold harmless Valley Troubadours, LLC, Troubadours Music Boosters, Inc., and their respective members, managers, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your breach of these Terms, (b) your violation of any applicable law or regulation, (c) your negligence or willful misconduct, or (d) any claim by a third party arising from your participation in the Services.

9.  Intellectual Property

All content on the Site and in Valley Troubadours program materials, including text, graphics, logos, audio clips, images, and software, is the property of Valley Troubadours, LLC or its content suppliers and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any Valley Troubadours content without prior written permission.

10.  Website Use and Acceptable Use

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • use the Site in any way that violates any applicable law or regulation;

  • attempt to gain unauthorized access to any portion of the Site or any system or network connected to the Site;

  • transmit any unsolicited communications, spam, or chain messages through the Site;

  • use any automated tools to scrape, crawl, or collect data from the Site without prior written consent; or

  • interfere with or disrupt the integrity or performance of the Site.

 

Valley Troubadours reserves the right to terminate or restrict your access to the Site at any time, for any reason, without notice.

11.  Privacy

Your use of the Site and Services is also governed by our Privacy Policy, which is incorporated herein by reference. Please review our Privacy Policy at www.valleytroubadours.com to understand our practices.

12.  Third-Party Services

Valley Troubadours uses third-party service providers to operate the enrollment platform (Enrollsy), process payments, send text messages (Twilio), and deliver email communications (Mailchimp/Intuit). Your use of these services may be subject to those providers' own terms and privacy policies. Valley Troubadours is not responsible for the acts or omissions of third-party service providers.

13.  Governing Law; Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services that cannot be resolved informally shall be submitted to binding arbitration in the State of Wisconsin under the commercial arbitration rules of the American Arbitration Association, or to the state or federal courts of competent jurisdiction in Wisconsin, at Valley Troubadours' election. You waive any right to a jury trial and any right to participate in a class action proceeding.

 

Before initiating any formal dispute resolution process, you agree to contact Valley Troubadours at customercare@belfryhall.com and make a good-faith effort to resolve the dispute informally. Valley Troubadours will use reasonable efforts to respond within a reasonable time.

14.  General Provisions

​

14.1  Entire Agreement

These Terms, together with our Privacy Policy and any enrollment-specific forms or agreements, constitute the entire agreement between you and Valley Troubadours with respect to the subject matter hereof and supersede all prior or contemporaneous communications or agreements.

 

14.2  Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

 

14.3  Waiver

Valley Troubadours' failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

 

14.4  Assignment

You may not assign or transfer your rights or obligations under these Terms without Valley Troubadours' prior written consent. Valley Troubadours may assign these Terms without restriction.

 

14.5  Force Majeure

Valley Troubadours shall not be liable for any failure or delay in performance arising from causes beyond its reasonable control, including without limitation acts of God, pandemic, weather events, governmental orders, facility closures, or power failures.

 

14.6  Notices

Valley Troubadours may provide notices to you via email, SMS, or posting on the Site. Notices are effective upon transmission or posting. To send notices to Valley Troubadours, email customercare@belfryhall.com.
